What you can expect

These terms explain how the website, products and services work, what you may do with the resources you access and what happens if there is a problem.

This website is operated by Rebecca Brissett, an Australian sole trader (ABN 85002032151).
In these terms, “I”, “me” and “my” refer to Rebecca Brissett.
“You” refers to a visitor, subscriber, customer or person using a product or service.

By using the website, creating an account, downloading a resource or
purchasing a product or service, you agree to these terms.

Additional terms may appear on a product page, checkout page, information pack,
proposal, quote or service agreement. If there is an inconsistency, the more specific
written terms for that product or service will take priority.

WEBSITE USE

Using the website responsibly

You are welcome to read, listen, browse and use the website for
lawful personal, professional and business purposes.

You must not:

  • interfere with the operation or security of the website;

  • attempt to gain unauthorised access to an account or restricted material;

  • use the website or its content in a misleading, unlawful or harmful way;

  • copy, scrape or systematically extract content for republication, resale, dataset creation or automated model training without written permission; or

  • infringe intellectual property, privacy or other legal rights.

PROFESSIONAL INFORMATION

Resources support, but do not replace, judgement

The website and its resources are designed to support thought, reflection and practical work. They do not replace professional advice or your responsibility to consider the circumstances in which they will be used.

Articles, podcasts, workbooks, practice tools, templates, video guidance and other resources provide general professional information and reflective practice material.

They are not legal, financial, clinical or regulatory advice. NDIS requirements, pricing arrangements, operational guidance and other external rules can change. You are responsible for checking current requirements and deciding whether information or a resource is appropriate for your organisation, role and circumstances.

Examples and prompts support thought and discussion. They do not guarantee a particular outcome, level of compliance, funding decision or service result.

PRODUCTS AND DESCRIPTIONS

Understanding what you are purchasing

I aim to explain each product clearly so you can decide whether it is suitable before purchasing or downloading it.

I take reasonable care to describe products and services accurately. Images, sample pages and previews are illustrative. Minor differences in layout, formatting or appearance may occur across devices, software and updated editions.

I may improve, correct or update a digital resource after publication. Unless otherwise stated, purchasing one resource does not include every future edition, additional product or separately released module.

Please read the relevant product page, inclusions and licence information before purchasing. If you are unsure whether a resource is suitable, you are welcome to contact me before placing an order.

PRICES AND PAYMENT

Paying for a product or service

Prices, taxes and payment requirements will be displayed before you purchase. You can pay through the website or ask to be invoiced directly.

Prices are displayed in Australian dollars unless stated otherwise. Whether GST is included will be shown on the relevant product, quote or checkout page.

Website payments are processed through third-party services, including Podia and Stripe. Your use of those services may also be governed by their terms and privacy policies.

You are responsible for providing accurate contact and billing information and ensuring that you are authorised to use the selected payment method.

Direct invoicing

If you would prefer to receive an invoice rather than pay through the website, email rebecca@rebeccabrissett.com and let me know which product or resource you would like to purchase.

Payment must be received in full before the product, file or access details are released. Any applicable licence terms, refund rights and Australian Consumer Law protections remain the same regardless of the payment method.

DELIVERY AND ACCESS

Receiving your digital product

Digital products and free downloads are generally delivered through Podia, by email or through a customer account.

You are responsible for providing a working email address, checking filtered or junk folders and maintaining access to your account.

If a purchased file or access email does not arrive or cannot be opened, contact rebecca@rebeccabrissett.com so I can investigate and, where reasonably possible, restore access or provide another copy.

Access may depend on Podia and other third-party systems. Temporary interruptions may occur because of maintenance, security requirements or circumstances outside my reasonable control.

USING THE RESOURCES

Your licence to use a product

Purchasing or downloading a resource gives you permission to use it within the licence provided. It does not transfer ownership of the resource or its intellectual property.

Unless a product page or separate written licence says otherwise, purchasing or downloading a resource gives the purchaser a limited, non-exclusive, non-transferable licence to use it for their own individual professional practice. You may save and print reasonable copies for that use.

You must not, without written permission:

  • share, forward, upload or distribute the resource or its downloadable files to other people;

  • reproduce the resource for organisation-wide use;

  • sell, sublicense or commercially distribute it;

  • remove authorship, copyright or branding information;

  • publish substantial portions online or include them in another product; or

  • present the resource as your own work.

Organisational and internal-use licences

Some products include a broader internal-use or organisational licence. Where that is stated, the resource may be used internally by the purchasing organisation within the scope described on the product page, information pack, quote or licence.

It must not be supplied to another legal entity, client organisation or unrelated third party unless permission is given in writing.

Free resources

Free resources remain subject to copyright and any licence stated on the resource or download page. “Free” refers to price and does not transfer ownership or create an unrestricted right to reproduce or distribute the material.

You may link to the public download page rather than sending copies of the downloaded file to others.

REFUNDS AND CONSUMER RIGHTS

If there is a problem with a purchase

Please contact me if a product is not supplied, cannot be accessed, is materially different from its description or has another significant problem.

Nothing in these terms excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded under the Australian Consumer Law or other applicable law.

Because digital products are usually available immediately, a refund is not ordinarily offered merely because you changed your mind, no longer need the resource or did not review the description before purchasing. This does not affect your rights if a product is faulty, materially different from its description, not supplied or otherwise fails to meet an applicable consumer guarantee.

If you believe there is a problem with a purchase, email rebecca@rebeccabrissett.com with your order details and a description of the issue. The appropriate remedy will depend on the circumstances and applicable law.

WORKSHOPS AND CONSULTING

Services are agreed separately

Workshops, speaking, facilitation, consulting and customised work may require a separate conversation and written agreement about scope, timing, fees and responsibilities.

These services may be subject to a proposal, quote, service agreement, cancellation policy or payment schedule.

An enquiry or introductory conversation does not create an obligation for either party to proceed. Work begins only after the relevant scope, timing, fees and terms have been agreed.

If separate written terms apply to a service, those terms take priority over these general website terms to the extent of any inconsistency.

ACCOUNTS AND SECURITY

Keeping access secure

If you create an account, you are responsible for keeping your login details confidential and for activity conducted through that account.

Please notify me promptly if you believe your access has been compromised.

I may suspend or restrict access where reasonably necessary to address non-payment, unlawful use, a security risk, licence infringement or a material breach of these terms.

INTELLECTUAL PROPERTY

Ownership of the work

The website and resources represent substantial professional and creative work. Access is provided for the permitted use, while ownership remains with the rights holder.

Unless otherwise stated, all content created by me, including writing, audio, video, graphics, workbooks, templates, tools, downloads and branding, is owned by or licensed to Rebecca Brissett.

You may quote brief extracts for genuine commentary, review or other uses permitted by law, with appropriate attribution. Any other reproduction, adaptation or commercial use requires prior written permission.

THIRD-PARTY SERVICES

Links and platforms outside my control

The website may link to third-party websites, platforms, information or services. These are operated independently and have their own terms and privacy practices.

I do not control those third parties and am not responsible for their availability, accuracy, security or privacy practices. A link does not necessarily indicate endorsement.

AVAILABILITY AND CHANGES

Keeping the website and resources current

I may update the website, correct resources, change future offerings or discontinue material that is no longer current or useful.

Where you have purchased a product, I will take reasonable steps to preserve the access promised at the time of purchase, subject to legal requirements, platform availability and circumstances outside my reasonable control.

I may update these terms when my products, services, providers or legal obligations change. The current version will be published on the website with its effective date. Changes will not remove rights that have already arisen under applicable law.

RESPONSIBILITY AND LIABILITY

The limits of general information

I take reasonable care in preparing my work, but you remain responsible for how you interpret, adapt and apply general information or resources within your own circumstances.

To the extent permitted by law, I am not responsible for loss arising solely from reliance on general information without appropriate consideration of your circumstances, or for indirect or consequential loss that was not reasonably foreseeable.

Nothing in these terms limits liability or responsibility where it would be unlawful to do so. Where a liability can lawfully be limited, any limitation will be applied only to the extent permitted by applicable law.

GOVERNING LAW

Which laws apply

These terms are governed by the laws of Victoria, Australia.

Commonwealth laws and any mandatory laws or rights that apply because of your location or where a service is delivered will continue to apply.

You and I submit to the courts and tribunals with jurisdiction in Victoria, subject to any right you have under applicable law to bring a claim elsewhere.

For consulting projects, the separate service agreement can identify the governing law and any location-specific obligations relevant to that engagement.
